The ninth circuit court has maintained a prohibition on sending state troops in Portland, Oregon, after a recent legal decision.

Appeals Court Agrees to Rehear Case

The ninth circuit court of appeals ruled on Tuesday that it would rehear the legal dispute concerning the president’s authority with an larger group of eleven justices. The judicial body also vacated a earlier decision from a smaller judicial group that had supported the administration.

Ongoing Dispute Over Troop Deployment

This legal directive represents the most recent development in a protracted court case over whether the administration has the legal right and justification to deploy state military units in the city. Approximately 200 federalized guard members have been in uncertainty since the end of September when the mobilization attempt was initiated in response to months of protests.

Differing Viewpoints

The federal government has claimed that government employees at the ICE facility in south Portland were facing threats, while local authorities assert that municipal police have command of the situation.

Contrary to descriptions of Portland as a conflict zone, locals have been posting footage of scenic paths and a thriving food scene, and organizing activities such as an protest bicycle event against the increased military presence.

Court Proceedings

The appeals court decision came after a US district judge in the city issued two legal injunctions this month – one blocking the federal control of the state troops, and another prohibiting the use of any national guard troops in the state, after efforts to circumvent the first order by calling up out-of-state forces.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – permitting command of state troops – but the subsequent injunction stayed effective, blocking the physical sending of the forces.

The latest ruling means the matter will be heard by the full court – with all decisions under review together – by a group of 11 judges.

“This ruling shows that the truth matters and that the judicial system are working to ensure government responsibility. The constitution restricts the executive authority, and local populations cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a statement.

“The court is sending a clear message: the president cannot dispatch the armed forces into American urban areas without cause. We will continue defending Oregon’s laws, principles, and autonomy as this legal proceeding progresses and our fight continues in the judicial system.”
